Shareholder groups of media and entertainment giant Disney (NYSE:DIS) have raised questions regarding the company’s decision to temporarily suspend Jimmy Kimmel’s show on ABC.
A letter from lawyers who represent the American Federation of Teachers, Reporters Without Borders, Inc., and others asked Disney to send them records related to Kimmel’s suspension to get clarity on the matter.
Kimmel was taken off the network for six days for his remarks on slain right-wing political activist Charlie Kirk. The move resulted in a public outcry by advocates from both sides of the political aisle and triggered a wave of subscription cancellations by users who believe the company participated in curbing free speech.
The letter condemned the company’s decision against the comedian and said investors had the right to investigate whether Disney executives failed to fulfill their fiduciary duties.
“Although we are pleased that ABC did the right thing and put Jimmy Kimmel back on the air last night, due to the Trump administration’s continued threats to free speech, including with respect to ABC, we are writing to seek transparency into the initial decision to suspend him and his show,” according to the letter sent on Wednesday.
“There is a credible basis to suspect that the Board and executives may have breached their fiduciary duties of loyalty, care, and good faith by placing improper political or affiliate considerations above the best interests of the Company and its stockholders.”
The letter also indicated that if Disney did not send them the records related to Kimmel’s suspension in five business days, they would sue them.
