Percepta AI, which was founded by former employees of Palantir Technologies (PLTR), has been blocked from poaching employees from their former employer and using its data, a Manhattan judge ruled.
US District Judge J. Paul Oetken ruled last month that Percepta AI was barred from recruiting staff for Percepta AI. However, the 41-page opinion was sealed due in part to confidential business information and certain customer and client data. Instead, he released a one-page order that summarized the findings. Now, several details of the opinion have been made public and indicate that Judge Oetken said Palantir would suffer “irreparable harm” if Percepta continued to take Palantir employees and use its data.
Despite Percepta’s inability to continue poaching Palantir employees, Judge Oetken added that Palantir’s non-compete requirement against the defendants, which include Hirsh Jain (Percepta’s CEO) and former Palantir engineer Joanna Cohen, was too broad and “sweeping.” As such, they will be allowed to continue working for Percepta.
The public details from the judge’s findings were first reported by Bloomberg.
Percepta is owned by venture capital firm General Catalyst and was publicly unveiled in October.
