Target (TGT), Walmart (WMT), and Amazon (AMZN)-owned Whole Foods Market have been added as defendants to a lawsuit against ByHeart, the maker of infant formula that was recalled due to botulism contamination.
Bill Marler, an attorney with Marler Clark, which specializes in food safety lawsuits, made the announcement in a blog post Sunday. He represents families who allege their children were sickened after consuming ByHeart formula.
Earlier in December, Walmart and Target received US FDA warning letters for not removing ByHeart products from shelves in some stores despite being notified of the recall.
“Retailers, that sold infant formula will need to step up – morally and legally – to help these families,” Marler wrote.
